Terms and conditions

These Terms & Conditions (“Terms”) apply to participation in yoga classes, workshops and related services offered by aureyoga (“aureyoga”, “we”, “us” or “our”).

By booking or participating in a yoga class or workshop, you acknowledge that you have read and accepted these Terms.

1. Registration and Booking

1.1. Participation in our yoga classes and workshops requires prior registration or booking, unless otherwise stated.

1.2. A booking becomes binding once it has been confirmed by aureyoga.

1.3. Places in classes and workshops are limited and are allocated on a first-come, first-served basis unless otherwise communicated.

1.4. Participants are responsible for providing accurate and complete information when making a booking.

2. Fees and Payment

2.1. The applicable participation fee is the price displayed at the time of booking or otherwise communicated by aureyoga.

2.2. Unless otherwise agreed, payment must be made before the start of the relevant class or workshop.

2.3. Available payment methods will be communicated during the booking process.

2.4. If a payment is not made on time, aureyoga may refuse participation until the outstanding amount has been paid.

3. Cancellation by Participants

3.1. Bookings may be cancelled free of charge up to 2 hours before the scheduled start of the class.

3.2. If a booking is cancelled less than 2 hours before the start of the class, or if a participant does not attend without cancelling, the full participation fee may be charged.

3.3. Cancellation must be made through the applicable booking system or by contacting aureyoga using the contact details provided for the booking.

3.4. Mandatory statutory consumer rights, including any applicable right of withdrawal under Austrian law, remain unaffected by these Terms.

4. Minimum Participation and Cancellation by Aureyoga

4.1. aureyoga may cancel a scheduled class if fewer than two participants are registered three hours before the scheduled start time.

4.2. If fewer than two participants are registered at that time, the class may be cancelled and will no longer be available for booking.

4.3. Any participant who is registered for the cancelled class will be informed of the cancellation three hours before the scheduled start time and will receive a full refund of the amount paid for the class.

4.4. The cancellation of a class under this section does not affect the participant’s ability to book or attend other classes.

5. Classes and Workshops

5.1. Class schedules, instructors, locations and formats may be subject to change.

5.2. Participants should arrive in sufficient time before the scheduled start of a class.

5.3. Late arrival may result in the participant being unable to join the class where this is necessary for safety, the orderly conduct of the class or the well-being of other participants. In such cases, the applicable cancellation conditions may still apply.

5.4. Participants must follow reasonable instructions given by the instructor, particularly where these relate to health and safety.

5.5. aureyoga may refuse or terminate participation where a participant behaves in a disruptive, threatening, abusive or otherwise inappropriate manner, or where participation would create a safety risk for the participant, the instructor or others.

6. Health and Personal Responsibility

6.1. Yoga is a form of physical activity and may involve physical exertion. Participation is voluntary and at the participant’s own responsibility.

6.2. Participants are responsible for assessing whether they are physically and medically able to participate safely.

6.3. Participants should inform the instructor before the class of any relevant injuries, physical limitations, pregnancy or other health-related circumstances that may affect their participation.

6.4. If a participant is uncertain whether yoga is appropriate for them due to a medical condition, they should consult a suitably qualified medical professional before participating.

6.5. Participants must perform exercises within their own individual physical limits and should stop an exercise immediately if they experience pain, dizziness, shortness of breath or other concerning symptoms.

6.6. Instruction provided during a yoga class is not medical advice, diagnosis or treatment and does not replace consultation with a qualified healthcare professional.

7. Liability

7.1. Participation in yoga classes and workshops involves inherent risks, including the risk of strains, falls and other physical injuries.

7.2. Participants voluntarily assume the ordinary risks associated with participation and are responsible for exercising appropriate care and following the instructor’s reasonable safety instructions.

7.3. Nothing in these Terms excludes or limits liability to the extent that such exclusion or limitation is prohibited by mandatory Austrian law. In particular, liability for personal injury caused by unlawful or negligent conduct cannot be excluded or restricted contrary to applicable law.

7.4. Participants are responsible for their personal belongings. 

8. Studio Rules and Personal Belongings

8.1. Participants must treat the premises, equipment, instructors and other participants with due care and respect.

8.2. Participants should only use yoga equipment in accordance with the instructions provided.

8.3. Personal belongings should be stored safely. Participants are encouraged not to bring valuables to class.

9. Intellectual Property

9.1. Instructional materials, videos, audio recordings, written materials, photographs, course concepts and other content provided by aureyoga are protected by applicable intellectual property laws.

9.2. Such materials may be used by participants for their own personal, non-commercial purposes only, unless aureyoga has given prior written consent for another use.

9.3. Reproduction, publication, commercial exploitation or distribution of aureyoga’s materials without permission is prohibited.

10. Photos and Recordings

10.1. Participants may not make audio or video recordings of classes, workshops, instructors or other participants without the prior consent of aureyoga and, where applicable, the persons concerned.

10.2. Any photography or recording carried out by aureyoga for promotional or other purposes will be subject to the applicable privacy and data-protection requirements.

11. Changes, Rescheduling and Cancellation by Aureyoga

11.1. aureyoga reserves the right to change instructors, schedules, locations or class formats where reasonably necessary.

11.2. aureyoga may cancel or reschedule a class or workshop for reasons other than the minimum participation requirement set out in Section 4, including illness, technical problems, operational reasons or circumstances beyond our reasonable control.

11.3. Where aureyoga cancels a booked class or workshop, participants will be informed as soon as reasonably possible.

11.4. Where applicable, aureyoga will offer a refund, credit or alternative date in accordance with the circumstances and applicable Austrian law.

12. Force Majeure

12.1. aureyoga shall not be responsible for delays, interruptions or cancellations caused by circumstances beyond our reasonable control, including natural disasters, epidemics, governmental measures, power failures or other comparable events.

12.2. Mandatory statutory rights of participants remain unaffected.

13. Privacy and Data Protection

13.1. aureyoga processes personal data in accordance with applicable data-protection legislation, including the General Data Protection Regulation (GDPR) and applicable Austrian data-protection law.

13.2. Further information about the collection, use and storage of personal data is provided in our separate Privacy Policy.

14. Consumer Rights

14.1. Nothing in these Terms is intended to restrict any mandatory rights that consumers have under Austrian or applicable European Union law.

14.2. Where applicable, consumers may have statutory rights of withdrawal or other consumer rights depending on the nature of the booking and the circumstances in which the contract was concluded.

14.3. Any statutory rights remain unaffected by these Terms.

15. Governing Law

15.1. These Terms are governed by the laws of the Republic of Austria, subject to mandatory consumer-protection provisions that may apply.

15.2. Where legally permissible, disputes arising from or in connection with these Terms shall be subject to the jurisdiction of the competent Austrian courts.

15.3. Mandatory statutory jurisdiction rights of consumers remain unaffected.

16. Severability

16.1. If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected.

16.2. The invalid or unenforceable provision shall be replaced, where legally possible, by a valid provision that most closely reflects its intended purpose.
